What are some reasons for choosing arbitration?
To obtain a decision by an arbitrator who is respected by the attorneys and parties
and to provide the parties a fair opportunity to present their case and be heard.
Why would you want to participate in a nonbinding arbitration?
It may be that the parties need to have an impartial person render a decision as to
the value or outcome of the case and the attorneys and parties can then use that
decision to form the basis for an ultimate settlement.
Why would you want to participate in a binding arbitration?
To bring closure to a dispute. The grounds for contesting an arbitration award are very
limited and restricted. See, Sections 15-48-130 and 140 S.C. Code of Laws.
